Mobile betting regulations approved by NY Gaming Commission

The much-anticipated mobile betting regulations have been approved by the New York Gaming Commission, and operators will now have a better idea of what could be expected of them

Some minor changes were made to the original regulations that were published in July during a Commission meeting on Monday before they were approved unanimously. A request for applications for providers was also made public in July.

This request for applications was used as a form of filter, as the rules insisted that only state-approved platforms and operators that went through it would be granted a license. The license-holder would then be allowed to operate for up to ten years.

Part of the rules focused on responsible gambling, as most do across the pond in Europe. In New York, gaming companies will be compelled to devise a problem gambling plan, which would be further inspected by the Commission, and also display responsible gambling information front-and-centre on their websites. Credit cards also come into this equation as, whilst players will be allowed to use them, there will be a $2,500 per year limit on deposits via this method.

With regards to bonuses and other promotional content, operators are expected to get all their details approved by the Commission at least 15 days before they are made available for public consumption.

Operators will also need to keep their servers inside casinos within New York State’s border in order to stay compliant with the state constitution, specifically the servers that process their bets. The casinos may receive a fee for hosting the servers for those who are technically their competitors.

FanDuel, Kambi, Bet365, Fox Bet and the Score are the six bidders currently in the running for mobile sportsbetting licences, according to the Commission’s statement last week.

FanDuel’s bid will also see both platform providers and operators such as DraftKings, BetMGM, and Bally’s enter the market – all paying a 50% tax rate as stipulated in the regulations. Again, the Commission gave tidbits of information on the application process.
