Sports wagering in Florida: extension requested in Seminole betting case

Earlier this week, US Solicitor General Elizabeth Prelogar, (in photo above), requested a second extension to file a response in the West Flagler and Associates versus Haaland case. This case, currently before the US Supreme Court, could significantly alter the legal status of sports betting in Florida.

Prelogar’s request for an extension until 12 May was due to the attorneys responsible for the government’s response being heavily engaged with other court matters. The Department of Justice, representing the US Department of the Interior, had initially been ordered to reply to West Flagler’s filing by 12 February. However, an extension until 12 April was granted by the Supreme Court.

West Flagler filed its writ of certiorari on 8 February, approximately seven months after a lower court overturned a ruling that permitted the Seminole tribe to launch its Hard Rock Bet platform in Florida. The case’s central issue is whether Deb Haaland, the Secretary of the Department of the Interior, had the authority to approve the 2021 compact between Florida and the Seminoles. This compact allows bets placed anywhere in Florida to be considered on tribal lands if they pass through a tribal server.

The Florida Supreme Court declined to hear a related case last month, in which West Flagler sued Governor Ron DeSantis and the legislature. West Flagler argued that they exceeded their power in approving the compact and questioned its legality, given the 2018 passage of Amendment 3, which mandates voter approval for any gambling expansion.

The US Supreme Court accepts between 100 and 150 of the roughly 7,000 cases filed with it each year. While some stakeholders believe the court might consider this case due to its implications for tribal sovereignty, the acceptance of any case is inherently uncertain.

The Supreme Court will now rule on the extension request in the Florida case. Once the Department of the Interior files its response, the court will begin deliberating on whether to hear the case. Meanwhile, the Seminoles launched their Hard Rock Bet platform, indicating the high stakes of this legal battle.
