KSA adds to the Dutch Gambling Act

The Dutch Gambling Authority (KSA) has published a new enforcement policy which will form part of the Dutch Gambling Act (WoK). This policy will task the Authority with addressing illegal gambling both online and in land-based venues in the Netherlands. In order to achieve this, the KSA will aim to increase visibility in the physical domain to combat the supply of physically illegal games of chance.

This is motivated by the perceived and increasing lack of safety throughout the gaming sector with regard to illegal gambling especially in relation to money laundering and counter-terrorism financing risks. The growing concern surrounding problem gambling is also of importance to his new policy as a report published by KSA stated:

“Gambling addiction is also lurking because there is no supervision of possible excessive gambling and there is the additional risk of money laundering.”

Collaboration with RIECs

The KSA has also announced it will collaborate with Regional Information and Expertise Centres (RIECs) in the hopes of uncovering subversive crime related to illegal gambling. This is an enforcement of a partnership which will continue to see the KSA refer specific cases to RIECs, particularly those requiring physical support during enforcement actions.

KSA rebrand

Additionally, the document also details the KSA’s initiative to rebrand as an independent entity that can act proactively to tackle illegal gambling. This was emphasised as the document details the KSA’s powers to initiate investigations at any time, as well as confiscation of gaming machines.

These investigations may be triggered by such instances as, if evidence of minors or young people’s involvement is found, the offences occur over multiple locations, if there have been multiple complaints, recidivism or if the illegal gambling could be seen as highly addictive. In cases triggered by these factors, the KSA may enforce fines, administrative orders and penalties through the Betting and Gaming Act. The document further revealed that these policies came into effect on December 1st, 2023.
